Terms of Service

1. Effective date

These terms took effect on September 15, 2026 and replace any earlier version.

2. Services

We design, build and host static websites; provide an AI telephone receptionist and dedicated tracking numbers; produce local search-optimized content; build and maintain lead-routing and follow-up automation; provide an owner reporting dashboard; and write marketing plans. The specific services for any engagement are those described in the written plan or proposal you approve.

3. Consultations and quotes

Discovery calls and audits are free unless stated otherwise. Written plans and quotes are valid for 30 days from the date issued. A quote describes a fixed scope; work outside that scope is quoted separately before it begins.

4. Service agreements

An engagement begins when you approve a written plan or proposal and pay any deposit it specifies. One-time builds are delivered in the stages the plan describes. Ongoing services (hosting, receptionist, refreshes, automation care, dashboard) are billed monthly and continue month to month until either party cancels with notice before the next billing date. You may cancel any ongoing service at any time; cancellation takes effect at the end of the period already paid.

5. Payment

Build fees are due as set out in the plan, typically a deposit at approval and the balance at launch. Monthly services are billed in advance. Invoices unpaid 15 days after the due date may result in suspension of ongoing services after written notice; we will never take a client's website offline without notice. Prices exclude any applicable taxes.

6. Ownership

You own your domain name, your website files and content, your telephone numbers provisioned for your business, and your lead and call data. On termination we will provide the site files and cooperate with porting or forwarding of your numbers. We retain ownership of our internal tools, scripts, templates, workflows and know-how, and grant you a license to use the deliverables built with them for your business indefinitely.

7. Your responsibilities

You are responsible for the accuracy of information you give us about your business, including licenses, insurance, service areas and claims about your work. You confirm you have the right to any logos, photos or text you supply. You agree to obtain any consent required to contact your own customers through the systems we build, and to use the receptionist and messaging tools in compliance with telephone and consumer-protection law.

8. Warranty

We warrant that deliverables will materially conform to the approved plan at launch, and will correct any nonconformity you report within 30 days of launch at no charge. Beyond that, services are provided "as is." We do not warrant search rankings, traffic, lead volume, call volume or revenue, and no statement by us should be read as such a promise.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from the site or the services is limited to the amounts you paid us in the three months before the claim arose. We are not liable for indirect, incidental, consequential or lost-profit damages, or for outages or failures of third-party providers (telephone carriers, hosting networks, messaging platforms) beyond our control.

10. Acceptable use

You may not use this site or our services to send unsolicited messages, to violate any law, to infringe others' rights, or to attempt to gain unauthorized access to any system. We may suspend services used in these ways after notice.

11. Intellectual property

The content of dynamicdigital.ai, including text, design and code, belongs to Dynamic Digital Marketing and may not be copied or republished without permission. Client sites we build are owned by the client as described in section 6.

12. Governing law

These terms are governed by the laws of the State of Nevada. Any dispute will be brought in the state or federal courts located in Clark County, Nevada, and both parties consent to that venue. Before filing, both parties agree to attempt in good faith to resolve the dispute by direct discussion for at least 30 days.

13. Changes

We may update these terms. The effective date will change when we do, and material changes affecting an active engagement will be sent to you in writing. Continued use of the site or services after a change means you accept the updated terms.
